#1. Stop And Call 911

Nevada law states that no matter how small the accident, you must stop your vehicle and call the police. If you are physically able, you must aid others injured in the crash until the police or ambulance arrives. Also, if you are able and the car is safe to drive, you must move your vehicle out of traffic.

Major accidents may result in obvious injuries, like broken bones and external wounds. Minor accidents may cause serious injuries that present a few days later, such as whiplash and brain trauma. Even if you think you are not hurt, when the ambulance shows up, let the crew take you to the hospital. Or, go to an urgent care facility and have the medical staff check for internal damage.

#2. Do Not Admit Fault

Regardless of what happened, do not admit fault. Under Nevada law, you may be eligible to recover damages, even if you are partially at fault. You may recover damages if you are 50% or less at fault, but the amount will be reduced by the percentage you are deemed to be negligent. However, if you are judged to be 51% or more at fault, you will be unable to recover damages.

#3. Collect Evidence

Assuming you are physically able, use your phone to take pictures and videos of all cars involved, the other driver(s), and any statements they make. Take photos of license plates and drivers’ licenses. Note the make and model of the other car(s).

Make sure you obtain the phone number, address, and insurance information from the other driver(s). Document the road conditions and weather. If there are witnesses to the accident, film their statements and get their contact information.

Avoid posting information about the accident online – sharing anything on social media about the accident could harm your case.

#4. Notify Your Insurance Company

Report the accident to your insurance company, either by calling them or using their app. If you suffered injuries and are hospitalized, have a family member or friend call the insurance company for you to open the case. In Nevada, you have two years to file an insurance claim, but the sooner you file, the better for your case.

#5. Avoid Communicating With The Other Driver’s Insurance Company
